Data protection declaration for the use of this website

In principle, it is possible to use the Compart IT-Solutions GmbH websites without providing any personal data. However, if a data subject wishes to use special services of our company via our website, processing of personal data could become necessary. If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the consent of the data subject.

The processing of personal data, such as the name, address, e-mail address, or telephone number of a data subject, is always carried out in accordance with the General Data Protection Regulation and in compliance with the country-specific data protection regulations applicable to Compart IT-Solutions GmbH. By means of this data protection declaration, our company would like to inform the public about the nature, scope, and purpose of the personal data we collect, use, and process. Furthermore, data subjects are informed of their rights by means of this data protection declaration.

As the controller, Compart IT-Solutions GmbH has implemented numerous technical and organizational measures to ensure the most complete protection of the personal data processed via this website. Nevertheless, Internet-based data transmissions can generally have security gaps, so that absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us via alternative means, for example by telephone.

4. Cookies
The Compart IT-Solutions GmbH websites use cookies. Cookies are text files that are placed and stored on a computer system via an Internet browser.

Numerous websites and servers use cookies. Many cookies contain a so-called cookie ID. A cookie ID is a unique identifier of the cookie. It consists of a string of characters through which websites and servers can be assigned to the specific Internet browser in which the cookie was stored. This allows the visited websites and servers to distinguish the individual browser of the data subject from other Internet browsers that contain other cookies. A specific Internet browser can be recognized and identified via the unique cookie ID.

Through the use of cookies, Compart IT-Solutions GmbH can provide users of this website with more user-friendly services that would not be possible without the cookie setting.

By means of a cookie, the information and offers on our website can be optimized in the interest of the user. As already mentioned, cookies allow us to recognize the users of our website. The purpose of this recognition is to make it easier for users to use our website. For example, the user of a website that uses cookies does not have to re-enter their access data every time they visit the website, because this is taken over by the website and the cookie stored on the user's computer system. Another example is the cookie of a shopping cart in an online shop. The online shop remembers the items that a customer has placed in the virtual shopping cart via a cookie.

The data subject can prevent the setting of cookies by our website at any time by means of a corresponding setting of the Internet browser used and thus permanently object to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time via an Internet browser or other software programs. This is possible in all common Internet browsers. If the data subject deactivates the setting of cookies in the Internet browser used, not all functions of our website may be fully usable.

You can change your cookie settings here at any time.

5. Collection of general data and information
The Compart IT-Solutions GmbH website collects a series of general data and information with every call to the website by a data subject or an automated system. This general data and information is stored in the server's log files. The following can be collected: (1) browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system reaches our website (so-called referrers), (4) the sub-websites that are accessed via an accessing system on our website, (5) the date and time of access to the website, (6) an Internet Protocol address (IP address), (7) the Internet Service Provider of the accessing system, and (8) other similar data and information that serve to avert danger in the event of attacks on our information technology systems.

When using this general data and information, Compart IT-Solutions GmbH does not draw any conclusions about the data subject. Rather, this information is needed to (1) deliver the content of our website correctly, (2) optimize the content of our website and the advertising for it, (3) ensure the long-term functionality of our information technology systems and the technology of our website, and (4) provide law enforcement authorities with the information necessary for criminal prosecution in the event of a cyberattack. This anonymously collected data and information is therefore evaluated by Compart IT-Solutions GmbH statistically and also with the aim of increasing data protection and data security in our company, in order to ultimately ensure an optimal level of protection for the personal data we process. The anonymous data of the server log files is stored separately from all personal data provided by a data subject.

6. Registration on our website
The data subject has the option of registering on the controller's website by providing personal data. The personal data transmitted to the controller is determined by the respective input mask used for registration. The personal data entered by the data subject is collected and stored exclusively for internal use by the controller and for its own purposes. The controller may arrange for the data to be passed on to one or more processors, for example a parcel service provider, who also uses the personal data exclusively for internal use attributable to the controller.

By registering on the controller's website, the IP address assigned by the Internet Service Provider (ISP) of the data subject, the date, and the time of registration are also stored. This data is stored against the background that this is the only way to prevent the misuse of our services and, if necessary, to enable the investigation of committed crimes. In this respect, the storage of this data is necessary for the protection of the controller. As a rule, this data is not passed on to third parties unless there is a legal obligation to do so or the disclosure serves the purpose of criminal prosecution.

The registration of the data subject with the voluntary provision of personal data is intended to enable the controller to offer the data subject content or services that, by their nature, can only be offered to registered users. Registered persons are free to change the personal data provided during registration at any time or to have it completely deleted from the controller's database.

The controller shall provide any data subject with information about which personal data is stored about the data subject at any time upon request. Furthermore, the controller shall correct or delete personal data at the request or notification of the data subject, provided that there are no statutory storage obligations to the contrary. All employees of the controller are available to the data subject as contact persons in this context.

7. Subscription to our newsletter
On the Compart IT-Solutions GmbH website, users are given the opportunity to subscribe to our company's newsletter. The personal data transmitted to the controller when ordering the newsletter is determined by the input mask used for this purpose.

Compart IT-Solutions GmbH informs its customers and business partners at regular intervals by means of a newsletter about company offers. In principle, the data subject can only receive our company's newsletter if (1) the data subject has a valid e-mail address and (2) the data subject registers for the newsletter dispatch. For legal reasons, a confirmation e-mail is sent to the e-mail address first entered by a data subject for the newsletter dispatch using the double opt-in procedure. This confirmation e-mail is used to verify whether the owner of the e-mail address as the data subject has authorized the receipt of the newsletter.

When registering for the newsletter, we also store the IP address of the computer system used by the data subject at the time of registration, as assigned by the Internet Service Provider (ISP), as well as the date and time of registration. The collection of this data is necessary in order to be able to trace the (possible) misuse of a data subject's e-mail address at a later date and therefore serves the legal protection of the controller.

The personal data collected as part of a registration for the newsletter will be used exclusively for sending our newsletter. Furthermore, subscribers to the newsletter could be informed by e-mail if this is necessary for the operation of the newsletter service or a registration in this regard, as could be the case in the event of changes to the newsletter offer or changes in technical circumstances. No personal data collected as part of the newsletter service will be passed on to third parties. The subscription to our newsletter can be terminated by the data subject at any time. The consent to the storage of personal data that the data subject has given us for the newsletter dispatch can be revoked at any time. For the purpose of revoking consent, a corresponding link can be found in every newsletter. Furthermore, it is possible to unsubscribe from the newsletter directly on the controller's website at any time or to inform the controller of this in another way.

Cleverreach
We use "CleverReach" on our website, a service provided by CleverReach GmbH & Co. KG, Mühlenstr. 43, 26180 Rastede, Germany (hereinafter referred to as: "CleverReach"). We use CleverReach to send our newsletter. For this purpose, the data you provide when registering for the newsletter is passed on to CleverReach. CleverReach uses this data for sending and for the statistical evaluation of the newsletters on our behalf. For this purpose, the newsletter e-mails contain web beacons or tracking pixels. These are one-pixel-sized image files that are stored on our websites. This allows your user behavior to be tracked, in particular whether you have opened the newsletter e-mail or which hyperlinks in the e-mail you have clicked on. CleverReach can also carry out conversion tracking, i.e., determine whether a previously defined action has taken place after clicking the hyperlink in the newsletter e-mail. In addition, technical information such as the time of access, your IP address, data on your web browser, and the operating system are recorded. This data is collected exclusively in a pseudonymized form. The data is not linked to other personal data. Direct personal identification is therefore excluded.

We use CleverReach on the basis of the consent you have given. The legal basis is Art. 6 (1) sentence 1 lit. a GDPR. We also use CleverReach for marketing and optimization purposes, in particular to analyze the use of our website and our newsletter and to be able to continuously improve individual functions and offers as well as the user experience for you. Through the statistical evaluation of user behavior, we can improve our offer and make it more interesting for you as a user. This also constitutes our legitimate interest in the processing of the above information. The legal basis is Art. 6 (1) sentence 1 lit. f GDPR.

You can revoke the consent you have given at any time. You can also object to the above processing at any time by unsubscribing from the newsletter. You can prevent the installation of cookies by deleting existing cookies and deactivating the storage of cookies in your web browser settings. Please note that in this case, you may not be able to use all functions of our website to their full extent. You can object to the collection and forwarding of personal data or prevent the processing of this data by deactivating the execution of Java-Script in your browser. In addition, you can prevent the execution of Java-Script code entirely by installing a Java-Script blocker (e.g., https://noscript.net/ or https://www.ghostery.com). Please note that in this case, you may not be able to use all functions of our website to their full extent.

In order to oblige CleverReach to process the transmitted data only in accordance with our instructions and to comply with the applicable data protection regulations, we have concluded a data processing agreement with CleverReach.

Information from the third-party provider: CleverReach GmbH & Co. KG, Mühlenstr. 43, 26180 Rastede, Germany. Further information from the third-party provider on data protection can be found on the following website: https://www.cleverreach.com/de/datenschutz/

8. Newsletter tracking
The newsletters of Compart IT-Solutions GmbH contain tracking pixels. A tracking pixel is a miniature graphic embedded in such e-mails sent in HTML format to enable log file recording and analysis. This allows for a statistical evaluation of the success or failure of online marketing campaigns. Based on the embedded tracking pixel, Compart IT-Solutions GmbH can recognize whether and when an e-mail was opened by a data subject and which links in the e-mail were accessed by the data subject.

Such personal data collected via the tracking pixels contained in the newsletters is stored and evaluated by the controller in order to optimize the newsletter distribution and to better adapt the content of future newsletters to the interests of the data subject. This personal data is not passed on to third parties. Data subjects are entitled at any time to revoke the respective separate declaration of consent given via the double opt-in procedure. After a revocation, this personal data will be deleted by the controller. Compart IT-Solutions GmbH automatically considers an unsubscribing from the receipt of the newsletter as a revocation.

9. Contact options via the website
In accordance with legal requirements, the Compart IT-Solutions GmbH website contains information that enables quick electronic contact with our company and direct communication, which also includes a general electronic mail address (e-mail address). If a data subject contacts the controller via e-mail or a contact form, the personal data transmitted by the data subject is automatically stored. Such personal data transmitted on a voluntary basis by a data subject to the controller is stored for the purpose of processing or contacting the data subject. This personal data is not passed on to third parties.

10. Comment function in the blog on the website
Compart IT-Solutions GmbH offers users the possibility to leave individual comments on individual blog posts on a blog located on the website of the controller. A blog is a portal maintained on a website, generally publicly viewable, in which one or more persons, called bloggers or web bloggers, can post articles or write down thoughts in so-called blog posts. The blog posts can generally be commented on by third parties.

If a data subject leaves a comment in the blog published on this website, information about the time of the comment entry as well as the user name (pseudonym) chosen by the data subject is stored and published in addition to the comments left by the data subject. Furthermore, the IP address assigned by the internet service provider (ISP) of the data subject is also logged. This storage of the IP address takes place for security reasons and in the event that the data subject violates the rights of third parties through a submitted comment or posts illegal content. The storage of this personal data is therefore in the controller's own interest, so that they could potentially exculpate themselves in the event of an infringement of rights. There is no disclosure of this collected personal data to third parties, unless such disclosure is required by law or serves the legal defense of the controller.

11. Subscription to comments in the blog on the website
The comments made in the blog of Compart IT-Solutions GmbH can generally be subscribed to by third parties. In particular, there is the possibility that a commenter subscribes to the comments following their comment on a particular blog post.

If a data subject decides to subscribe to comments, the controller will send an automatic confirmation e-mail to check in a double-opt-in procedure whether the owner of the specified e-mail address has actually decided to subscribe to this option. The option to subscribe to comments can be terminated at any time.

12. Routine erasure and blocking of personal data
The controller shall process and store the personal data of the data subject only for the period necessary to achieve the purpose of storage, or as far as this is granted by the European legislator or other legislators in laws or regulations to which the controller is subject.

If the storage purpose is not applicable, or if a storage period prescribed by the European legislator or another competent legislator expires, the personal data are routinely blocked or erased in accordance with legal requirements.

If a data subject wishes to exercise this right of confirmation, they may, at any time, contact any employee of the controller.

<b>Right of access</b>
Every data subject affected by the processing of personal data has the right granted by the European legislator to obtain at any time from the controller free information about the personal data stored about them and a copy of this information. Furthermore, the European legislator has granted the data subject access to the following information: the purposes of the processing; the categories of personal data being processed; the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations; where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period; the existence of the right to request rectification or erasure of personal data or restriction of processing of personal data concerning the data subject or to object to such processing; the right to lodge a complaint with a supervisory authority; where the personal data are not collected from the data subject: any available information as to their source; the existence of automated decision-making, including profiling, referred to in Article 22(1) and (4) GDPR and, at least in these cases, meaningful information about the logic involved, as well as the significance and the envisaged consequences of such processing for the data subject. Furthermore, the data subject has a right of access as to whether personal data were transferred to a third country or to an international organization. Where this is the case, the data subject also has the right to be informed of the appropriate safeguards relating to the transfer. If a data subject wishes to exercise this right of access, they may, at any time, contact any employee of the controller.

c) Right to rectification
Every data subject affected by the processing of personal data has the right granted by the European legislator to obtain without undue delay the rectification of inaccurate personal data concerning them. Furthermore, the data subject has the right to have incomplete personal data completed, including by means of providing a supplementary statement, taking into account the purposes of the processing. If a data subject wishes to exercise this right to rectification, they may, at any time, contact any employee of the controller.

d) Right to erasure (right to be forgotten)
Every data subject affected by the processing of personal data has the right granted by the European legislator to obtain from the controller the erasure of personal data concerning them without undue delay, provided that one of the following grounds applies and as long as the processing is not necessary: The personal data were collected or otherwise processed for such purposes for which they are no longer necessary. The data subject withdraws consent on which the processing is based according to point (a) of Article 6(1) GDPR or point (a) of Article 9(2) GDPR, and there is no other legal ground for the processing. The data subject objects to the processing pursuant to Article 21(1) GDPR, and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Article 21(2) GDPR. The personal data have been unlawfully processed. The erasure of the personal data is necessary for compliance with a legal obligation in Union or Member State law to which the controller is subject. The personal data have been collected in relation to the offer of information society services referred to in Article 8(1) GDPR. If one of the above-mentioned reasons applies and a data subject wishes to request the erasure of personal data stored at Compart IT-Solutions GmbH, they may, at any time, contact any employee of the controller. The employee of Compart IT-Solutions GmbH will ensure that the request for erasure is complied with immediately. If the personal data have been made public by Compart IT-Solutions GmbH and our company as controller is obliged pursuant to Article 17(1) GDPR to erase the personal data, Compart IT-Solutions GmbH, taking account of available technology and the cost of implementation, shall take reasonable steps, including technical measures, to inform other controllers processing the published personal data that the data subject has requested erasure by such controllers of any links to, or copy or replication of, those personal data, as far as processing is not required. The employee of Compart IT-Solutions GmbH will arrange the necessary measures in individual cases.

e) Right to restriction of processing
Every data subject affected by the processing of personal data has the right granted by the European legislator to obtain from the controller restriction of processing where one of the following applies: The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data. The processing is unlawful, the data subject opposes the erasure of the personal data and requests the restriction of their use instead. The controller no longer needs the personal data for the purposes of the processing, but they are required by the data subject for the establishment, exercise, or defense of legal claims. The data subject has objected to processing pursuant to Article 21(1) GDPR and it is not yet verified whether the legitimate grounds of the controller override those of the data subject. If one of the above-mentioned conditions is met and a data subject wishes to request the restriction of personal data stored at Compart IT-Solutions GmbH, they may, at any time, contact any employee of the controller. The employee of Compart IT-Solutions GmbH will arrange the restriction of the processing.

f) Right to data portability
Every data subject affected by the processing of personal data has the right granted by the European legislator to receive the personal data concerning them, which was provided by the data subject to a controller, in a structured, commonly used, and machine-readable format. They also have the right to transmit those data to another controller without hindrance from the controller to which the personal data have been provided, as long as the processing is based on consent pursuant to point (a) of Article 6(1) GDPR or point (a) of Article 9(2) GDPR or on a contract pursuant to point (b) of Article 6(1) GDPR, and the processing is carried out by automated means, as long as the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller. Furthermore, in exercising their right to data portability pursuant to Article 20(1) GDPR, the data subject has the right to have the personal data transmitted directly from one controller to another, where technically feasible and when doing so does not adversely affect the rights and freedoms of others. To assert the right to data portability, the data subject may at any time contact any employee of Compart IT-Solutions GmbH.

g) Right to object
Every data subject affected by the processing of personal data has the right granted by the European legislator to object, on grounds relating to their particular situation, at any time, to processing of personal data concerning them which is based on point (e) or (f) of Article 6(1) GDPR. This also applies to profiling based on these provisions. Compart IT-Solutions GmbH shall no longer process the personal data in the event of the objection, unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the data subject, or for the establishment, exercise, or defense of legal claims. If Compart IT-Solutions GmbH processes personal data for direct marketing purposes, the data subject shall have the right to object at any time to processing of personal data concerning them for such marketing. This applies to profiling to the extent that it is related to such direct marketing. If the data subject objects to Compart IT-Solutions GmbH to the processing for direct marketing purposes, Compart IT-Solutions GmbH will no longer process the personal data for these purposes. In addition, the data subject has the right to object, on grounds relating to their particular situation, to processing of personal data concerning them by Compart IT-Solutions GmbH for scientific or historical research purposes or for statistical purposes pursuant to Article 89(1) GDPR, unless the processing is necessary for the performance of a task carried out for reasons of public interest. To exercise the right to object, the data subject may contact any employee of Compart IT-Solutions GmbH or another employee directly. The data subject is also free, in the context of the use of information society services, and notwithstanding Directive 2002/58/EC, to use their right to object by automated means using technical specifications.

14. Data protection for applications and in the application processThe controller collects and processes the personal data of applicants for the purpose of handling the application process. The processing can also be carried out electronically. This is particularly the case if an applicant submits corresponding application documents electronically, for example by e-mail or via a web form on the website, to the controller. If the controller concludes an employment contract with an applicant, the transmitted data will be stored for the purpose of handling the employment relationship in compliance with statutory provisions. If no employment contract is concluded with the applicant by the controller, the application documents will be automatically deleted two months after the announcement of the rejection decision, provided that no other legitimate interests of the controller stand in the way of deletion. Other legitimate interest in this sense is, for example, a burden of proof in proceedings under the General Equal Treatment Act (AGG).

15. Data protection provisions regarding the deployment and use of Facebook
The controller has integrated components of the company Facebook on this website. Facebook is a social network. A social network is a social meeting place operated on the internet, an online community that generally allows users to communicate with each other and interact in virtual space. A social network can serve as a platform for the exchange of opinions and experiences or allows the internet community to provide personal or company-related information. Facebook allows users of the social network, among other things, to create private profiles, upload photos, and network via friend requests. The operating company of Facebook is Facebook, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. If a data subject lives outside the USA or Canada, the controller for the processing of personal data is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. Each time one of the individual pages of this website, which is operated by the controller and on which a Facebook component (Facebook plug-in) has been integrated, is accessed, the internet browser on the data subject's information technology system is automatically prompted by the respective Facebook component to download a display of the corresponding Facebook component from Facebook. A complete overview of all Facebook plug-ins can be accessed at https://developers.facebook.com/docs/plugins/?locale=de_DE. As part of this technical process, Facebook receives information about which specific subpage of our website is visited by the data subject. If the data subject is logged into Facebook at the same time, Facebook recognizes with each call-up of our website by the data subject and for the entire duration of the respective stay on our website which specific subpage of our website the data subject is visiting. This information is collected by the Facebook component and assigned by Facebook to the respective Facebook account of the data subject. If the data subject clicks on one of the Facebook buttons integrated on our website, for example the "Like" button, or if the data subject submits a comment, Facebook assigns this information to the personal Facebook user account of the data subject and stores this personal data. Facebook always receives information via the Facebook component that the data subject has visited our website if the data subject is logged into Facebook at the time of accessing our website; this takes place regardless of whether the data subject clicks on the Facebook component or not. If such a transmission of this information to Facebook is not desired by the data subject, they can prevent the transmission by logging out of their Facebook account before accessing our website. The data policy published by Facebook, which is available at https://de-de.facebook.com/about/privacy/, provides information about the collection, processing, and use of personal data by Facebook. Furthermore, it explains what setting options Facebook offers to protect the privacy of the data subject. In addition, various applications are available that make it possible to suppress data transmission to Facebook. Such applications can be used by the data subject to suppress data transmission to Facebook.

16. Data protection provisions regarding the deployment and use of Google+
The controller has integrated the Google+ button as a component on this website. Google+ is a so-called social network. A social network is a social meeting place operated on the internet, an online community that generally allows users to communicate with each other and interact in virtual space. A social network can serve as a platform for the exchange of opinions and experiences or allows the internet community to provide personal or company-related information. Google+ allows users of the social network, among other things, to create private profiles, upload photos, and network via friend requests. The operating company of Google+ is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA. Each time one of the individual pages of this website, which is operated by the controller and on which a Google+ button has been integrated, is accessed, the internet browser on the data subject's information technology system is automatically prompted by the respective Google+ button to download a display of the corresponding Google+ button from Google. As part of this technical process, Google receives information about which specific subpage of our website is visited by the data subject. More detailed information about Google+ is available at https://developers.google.com/+/. If the data subject is logged into Google+ at the same time, Google recognizes with each call-up of our website by the data subject and for the entire duration of the respective stay on our website which specific subpage of our website the data subject is visiting. This information is collected by the Google+ button and assigned by Google to the respective Google+ account of the data subject. If the data subject clicks on one of the Google+ buttons integrated on our website and thereby gives a Google+1 recommendation, Google assigns this information to the personal Google+ user account of the data subject and stores this personal data. Google stores the Google+1 recommendation of the data subject and makes it publicly accessible in accordance with the terms and conditions accepted by the data subject in this regard. A Google+1 recommendation made by the data subject on this website is subsequently stored and processed together with other personal data, such as the name of the Google+1 account used by the data subject and the photo stored therein, in other Google services, for example, the search engine results of the Google search engine, the Google account of the data subject, or in other places, for example, on websites or in connection with advertisements. Furthermore, Google is able to link the visit to this website with other personal data stored by Google. Google also records this personal information for the purpose of improving or optimizing the various services of Google. Google always receives information via the Google+ button that the data subject has visited our website if the data subject is logged into Google+ at the time of accessing our website; this takes place regardless of whether the data subject clicks on the Google+ button or not. If a transmission of personal data to Google is not desired by the data subject, they can prevent such a transmission by logging out of their Google+ account before accessing our website. Further information and the applicable data protection provisions of Google can be accessed at https://www.google.de/intl/de/policies/privacy/. Further notes from Google regarding the Google+1 button can be accessed at https://developers.google.com/+/web/buttons-policy.

17. Data protection provisions regarding the deployment and use of Instagram
The controller has integrated components of the service Instagram on this website. Instagram is a service that can be classified as an audiovisual platform and allows users to share photos and videos and also to redistribute such data in other social networks. The operating company of the services of Instagram is Instagram LLC, 1 Hacker Way, Building 14 First Floor, Menlo Park, CA, USA. Each time one of the individual pages of this website, which is operated by the controller and on which an Instagram component (Insta button) has been integrated, is accessed, the internet browser on the data subject's information technology system is automatically prompted by the respective Instagram component to download a display of the corresponding component from Instagram. As part of this technical process, Instagram receives information about which specific subpage of our website is visited by the data subject. If the data subject is logged into Instagram at the same time, Instagram recognizes with each call-up of our website by the data subject and for the entire duration of the respective stay on our website which specific subpage the data subject is visiting. This information is collected by the Instagram component and assigned by Instagram to the respective Instagram account of the data subject. If the data subject clicks on one of the Instagram buttons integrated on our website, the data and information transmitted thereby are assigned to the personal Instagram user account of the data subject and stored and processed by Instagram. Instagram always receives information via the Instagram component that the data subject has visited our website if the data subject is logged into Instagram at the time of accessing our website; this takes place regardless of whether the data subject clicks on the Instagram component or not. If such a transmission of this information to Instagram is not desired by the data subject, they can prevent the transmission by logging out of their Instagram account before accessing our website. Further information and the applicable data protection provisions of Instagram can be accessed at https://help.instagram.com/155833707900388 and https://www.instagram.com/about/legal/privacy/.

Further information about the Twitter buttons is available at https://about.twitter.com/de/resources/buttons. As part of this technical process, Twitter receives information about which specific subpage of our website is visited by the data subject. The purpose of integrating the Twitter component is to enable our users to redistribute the content of this website, to make this website known in the digital world, and to increase our visitor numbers. If the data subject is logged into Twitter at the same time, Twitter recognizes with each call-up of our website by the data subject and for the entire duration of the respective stay on our website which specific subpage of our website the data subject is visiting. This information is collected by the Twitter component and assigned by Twitter to the respective Twitter account of the data subject. If the data subject clicks on one of the Twitter buttons integrated on our website, the data and information transmitted thereby are assigned to the personal Twitter user account of the data subject and stored and processed by Twitter. Twitter always receives information via the Twitter component that the data subject has visited our website if the data subject is logged into Twitter at the time of accessing our website; this takes place regardless of whether the data subject clicks on the Twitter component or not. If such a transmission of this information to Twitter is not desired by the data subject, they can prevent the transmission by logging out of their Twitter account before accessing our website. 22. Legal basis for processing
Art. 6(1)(a) GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is a party, as is the case, for example, with processing operations necessary for the supply of goods or the provision of any other service or consideration, the processing is based on Art. 6(1)(b) GDPR. The same applies to such processing operations that are necessary for the implementation of pre-contractual measures, for example in cases of inquiries about our products or services. If our company is subject to a legal obligation by which processing of personal data is required, such as for the fulfillment of tax obligations, the processing is based on Art. 6(1)(c) GDPR. In rare cases, the processing of personal data might be necessary to protect vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured in our company and their name, age, health insurance data, or other vital information had to be passed on to a doctor, hospital, or other third party. Then the processing would be based on Art. 6(1)(d) GDPR. Finally, processing operations could be based on Art. 6(1)(f) GDPR. Processing operations that are not covered by any of the aforementioned legal bases are based on this legal basis if the processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by the interests, fundamental rights, and freedoms of the data subject. Such processing operations are permitted to us in particular because they were specifically mentioned by the European legislator. It took the view that a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47, sentence 2 GDPR).

23. Legitimate interests in the processing pursued by the controller or by a third partyIf the processing of personal data is based on Article 6(1)(f) GDPR, our legitimate interest is the conduct of our business activities for the benefit of the well-being of all our employees and our shareholders.

24. Period for which the personal data will be storedThe criterion for the duration of the storage of personal data is the respective statutory retention period. After the expiry of this period, the corresponding data is routinely deleted, provided it is no longer required for the fulfillment or initiation of a contract.

25. Statutory or contractual provisions for the provision of personal data; necessity for the conclusion of a contract; obligation of the data subject to provide the personal data; possible consequences of failure to provide such dataWe inform you that the provision of personal data is partly required by law (e.g., tax regulations) or may result from contractual provisions (e.g., information on the contractual partner). Sometimes, it may be necessary for the conclusion of a contract that a data subject provides us with personal data, which must subsequently be processed by us. For example, the data subject is obliged to provide us with personal data when our company enters into a contract with them. Failure to provide the personal data would mean that the contract with the data subject could not be concluded. Before providing personal data, the data subject must contact one of our employees. Our employee will clarify to the data subject on a case-by-case basis whether the provision of the personal data is required by law or contract or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data, and what the consequences of not providing the personal data would be.
